All of the construction projects for MiraCosta College are considered public works projects as per California labor code. This requires all potential bidders and contractors to be registered as ‘public works contractors’ with the state of California through the Department of Industrial Relations (DIR).
MCCD utilizes the California Uniform Public Construction Costa Accounting Act (CUPCCAA) for bid advertising. The Act provides for alternative bidding procedures pursuant to state contract code as follows:
(a) Public projects of $60,000 or less may be performed by negotiated contract or by purchase order (PCC22032(a)).
(b) Public projects of $200,000 or less may be let to contract by informal procedures set forth in the Act (PCC22032(b)).
(c) Public projects of more than $200,000 shall be let to contract by formal bidding procedures (PCC22032(c)).

All bids, Requests for Proposal (RFP), and Requests for Qualifications (RFQ) require registration to make sure all bidders/proposers receive potential addenda required for a full responsive bid/proposal. Labor Compliance
Construction contracts for MiraCosta projects are subject to California labor laws regarding public works projects. The MiraCosta Community College District intends that all workers be paid the proper prevailing wage, that there are opportunities for apprentice work, required training fund contributions are made, and certified payroll reporting is completed for applicable projects.
The district monitors all Measure MM projects for compliance with these requirements and as part of its responsibilities as an awarding body. Noncompliance with the law regarding payment of prevailing wages can result in action by the California Division of Labor Standards Enforcement. Workers have a right to file a public works complaint if they believe there has been a violation, including failure to pay prevailing wage and use apprentices.
California law requires all public works contractors to be registered as such with the DIR before submitting any bids on public works projects.

MiraCosta is committed to promoting Measure MM contract opportunities to all contractors, professional service providers, vendors, and other businesses.
The district places an emphasis on identifying and providing notifications about bid opportunities to the following targeted businesses:
- Small or Underutilized Businesses: Includes business who have one or more certifications as a historically underutilized business, including:
- Disabled Veteran Business Enterprise (DVBE)
- Disadvantaged Business Enterprise (DBE)
- LGBT Business Enterprise (LGBTBE)

- Local Businesses: Includes businesses located outside of MCCD boundaries but within greater San Diego County
- Regional Businesses: Includes business located outside of San Diego County but within a regional 50-mile radius of MiraCosta’s Oceanside campus
Eligible and interested businesses reflecting these characteristics are included in MCCD’s Contractor Database and are provided direct notifications of bid opportunities. Firms interested in being included on the Contractor Database are asked to complete our Bid Notifications Interest Form. A copy of the form and any required documentation can be emailed to mccdbondprocurement@kitchell.com. These small business groups may be eligible for no-cost business counseling through the North San Diego Small Business Development Center, based at MiraCosta’s Technology Career Institute, and dedicated to increasing the economic vitality of the community be helping small businesses and entrepreneurs build a foundation for success and growth.
