MiraCosta College works to make sure all students feel welcomed and have the tools
they need to succeed, regardless of immigration status. UPRISE strives to make sure
undocumented, DACAmented, and mix-status students at MiraCosta College feel safe and
supported by providing access to immigration legal services, offering academic and
mental health counseling, and connecting students to financial and academic resources.
MiraCosta College will not release any personally identifiable student information,
including any data related to immigration status, without a judicial warrant, subpoena
or court order, unless authorized by the student or required by law.
Current State of DACA
On July 6, 2022, the Fifth Circuit Court of Appeals heard oral arguments in the Texas litigation. These arguments related to whether Texas and the other states that are challenging the legality of the DACA program have “standing” or the ability to bring their lawsuit. The arguments will also address the legality of the 2012 DACA Memorandum itself. On July 7, 2022, the Eastern District of New York heard oral arguments in Batalla Vidal. The issues addressed at this hearing were different from the issues in the Texas case.

History
The Deferred Action for Childhood Arrivals (DACA) program was established by the U.S. Department of Homeland Security (DHS) in June 2012. Under this program, individuals meeting specified requirements can apply to have a deportation action deferred and employment authorization for two years, subject to renewal for an additional two years. Students under DACA are considered by DHS to be lawfully present in the United States during the period of deferred action.
Tuition / Fees and Financial Aid Eligibility for DACA Students
If you are a DACA student and don’t meet AB540 criteria you can still be classified as resident for purposes of assessing tuition, awarding the California College Promise Grant (formerly known as BOGW Fee Waiver), and determining eligibility for services that require California residency such as EOPS. To qualify you must meet the California law related to physical presence and the intent to make California home for other than a temporary purpose.
