An injury under Workers’ Compensation law is defined as one which resulted from an event or accident that either arose out of employment or in the course and scope of employment. This would include specific trauma or accident and/or cumulative trauma. Reference AP7343 Industrial Accidents and Illness.
Who is eligible to file a claim for Workers' Compensation benefits?
All MiraCosta employees (including paid classroom aides and student workers) and district approved volunteers. Students who are enrolled in the Nursing & Surgical Technology programs and injured during their vocational training at approved medical center facilities are also eligible. Campus and classroom incidents fall under the Student Accident Insurance program and are administered by the Health Services Department.
How do I report a work injury?
Notify your supervisor and/or Risk Management (Risk & Safety Manager) as soon as possible but no later than five days from the date of injury even if no medical attention is needed. Failure to report a work related injury in a timely manner will result in your claim being investigated causing a delay in processing. The statute of limitation for filing a claim is one year from the date you became aware of the injury and/or its cause.
What do I do if I need medical treatment for my injury?
If you are injured at the Oceanside Campus:
Go to Health Services, building 3300. Health Services can provide; first aid, paperwork to file a claim, and a referral to the district’s Occupational Medicine clinic, Concentra, if needed. Concentra is located at 3910 Vista Way, Suite 106, Oceanside (next to Home Depot); open Monday – Friday 7am-7pm and Saturday 8am-2pm. If you are injured after 7pm and you feel that you need immediate medical attention, contact MiraCosta Police or go to Tri City Hospital emergency room, 4002 Vista Way in Oceanside.
If you are injured at the San Elijo Campus:
Go to Health Services, building 900. Health Services can provide; first aid, paperwork to file a claim, and a referral to the district’s Occupational Medicine clinic, Concentra, if needed. Concentra is located at 5810 El Camino Real, Suite A, Carlsbad (Faraday Ave & El Camino Real North of Palomar Airport Road), open Monday – Friday 7am-6pm. The Administrative Secretary located in the Administration building can also provide you with the necessary paperwork. If you are injured after 6pm and you need immediate medical attention, go to Scripps Hospital emergency room, 354 Santa Fe Dr. in Encinitas.
If you are injured at the Community Learning Center:
Contact the on-duty MiraCosta Police Officer to obtain the necessary paperwork. If medical treatment is needed, go to Concentra located at 3910 Vista Way, Suite 106, Oceanside (next to Home Depot); open Monday – Friday 7am-7pm and Saturday 8am-2pm. How do I file a claim for Workers' Compensation benefits?
You will receive a claim form and Supervisor's Report of Accident form. Complete and return the claim form to Risk Management (Risk & Safety Manager), Mail Station 14. Complete the supervisor’s report with your supervisor and return it to Risk Management (Risk & Safety Manager) as soon as possible. If no medical expenses are incurred, return only the supervisor's report to Risk Management (Risk & Safety Manager). No action will be taken unless or until you request medical treatment. In this event, you must complete and return the claim form to Risk Management (Risk & Safety Manager) at which time a referral to the district’s Occupational Medicine clinic will be provided.
